Will Social Security Disability benefits be considered income in a bankruptcy plan?

I am in a Chapt.13 bankruptcy, became diagnosed with a fatal disease, had to quit my job and just now have been approved for Social Security Disability benefits. Will my monthly benefit be considered income regarding my bankruptcy?

Yes all income will be considered. The basis of your repayment plan is your income versus the debt.

If you cancel the bankruptcy, your creditors could sue you but they wouldn’t be able to garnish your SSD — only child support and Federal type debts can garnish SSD.
