you have to file a claim with social security-they will pay you off his benefit. It won’t even affect how much he gets-but it does depend on how many other peole are collecting off of him-it gets divided evenly-like my daughters get 196 per month-if his other kid had filed they would get 196X2 divided by three

you do not need a lawyer-call social security

If you have a court order you need to enforce it by going and file a violation petition for him not paying . He will get served with the papers with the time and date of your violation hearing in which they will reinforce his original order. The judge will make him pay if he is recieving social security, you really have no way out of paying child support unless your dead. Go file asap and any arrears will be added and he will be given a date to which he has to be caught up to.

Go to social security. Your father cannot keep you from collecting a child’s portion of his benefits. Take proof that there is a court order and proof that you are a minor. One of the few reasons why social security can be attached is back child support. talk to the social security examiner and ask her what you have to do to attach a portion of his benefits for back support and file with them for future support. I believe even if you are no longer a minor, you can still have his benefits attached for back support. Make sure your mother or legal guardian goes with you. Also, just to see if you can get the sorry S.O.B. in trouble, I would go back to the court that gave the order for support and advise them he is receiving social security.

Disability benifits are very small. If that’s his only source of income and he has no other money, your chances aren’t very good.
