Hey my brother is behind $5,000 in child support and he just recently got approved for his disability..He’s suppose to get his first check on the 3rd of next mth and he’s expecting a big lump sum because he’s been trying to get disability for 7mths and just got apporved last week..
Now we were arguing because i told him hes not going to get anyting as long as he is behind on childsupport..Am i right?

u ar rite!if he has a judgement for the children he sired .he will pay.

he will have to give his ex whatever a pecentage of his backpay and a certain percentage each month will be deducted from his disability check until his child support obligations are over as decreed by the court!!!
i believe each state has different percentages that they are allowed to deduct!!!
he can not avoid payin it, its a federal thing now!!!

No! Not necessarily! Please, my friend, get your brother to a legal aid clinic to discuss all the facts with an atty. Find free legal advice by contacting (Name of Your State) Bar Association Lawyer Referral service. Act quickly, esp if there may be outstanding court orders.

yes a person on disability can be ordered to pay child support and can have there check garnished…i got ordered to pay child support while on disability and because they back ordered it for a few years i used the sum payment to pay off all the back amount owed…when it was ordered they knew what my monthly benefits would be as i had my award letter with me and they ordered my montly payments to be 60% of that

Yes they can and they will. There is a max amout they can take, each state is different. Consult with an attorney if possible. If he his smart, he will inform child support enforcement of his new income and request a hearing. At the hearing, make a payment arrangement for the arrears and ask for a redeterminatio of the amount based on his new income.

Yes, they did me, also, his child will also get a check from his disability each month.
